The bailiff has informed you that your wages, benefits, household effects, motor vehicle or bank account have been seized. In formal terms, he oversigned a writ of garnishment. Here you can read what this means and what the next steps are.

Seizure-exempt threshold

You can find the amount that you will continue to receive yourself on the page with the explanation or calculation of the seizure-exempt rate. If you provide full insight into your living situation and sources of income, this can lead to an increase in the seizure-exempt rate. If you do not have a residential address in the Netherlands or if you only have a postal address in the Netherlands, a different calculation of the seizure-exempt rate applies. You can find more information about this on the website of your seizure-exempt foot.

Seizure on other income

If other income from you or your partner has already been seized, you must notify the bailiff. You must also indicate who has seized the property and on what income.

Seizure of your income

The bailiff has seized your income. Your employer or benefits agency is obliged to withhold part of your income on this basis. They may no longer pay you, but the bailiff to pay off your debt.

Seizure of your car or other motor vehicle

As of April 1, 2021, the bailiff can administratively seize the car or other motor vehicle from behind his desk via the vehicle registration register. The bailiff no longer has to look for the vehicle. You can then no longer sell the vehicle yourself. The RDW places a so-called blockade on your vehicle and a potential buyer can see in the vehicle registration register that it has been seized. There is no ban on seizure of a car that you need for your work.

The official report that the bailiff has handed over to you describes which vehicle has been seized and on which date it will be sold in public. Please note that the sale will be announced through a website. The bailiff will let you know via which website and during which period you can bid on your vehicle. You must pay the costs thereof.

Seizure of your bank account

If an account of a company (a legal entity) has been seized, everything in the account has been officially seized. If a personal account has been attached (an account of a natural person), then everything is also subject to the attachment, with the exception of the seizure-exempt amount stated on the writ. This also includes benefits that are not subject to seizure, such as child benefit. Payments that arrive on your account after the seizure are not covered by the attachment.

A bank will generally block the account as a result of the seizure. For that reason, you should contact your bank to get the account back as soon as possible.

Seizure of your household effects

The official report that the bailiff has handed over to you describes which items have been seized and on which date they will be sold in public.

You should bear in mind that before the sale notices are posted at your home and at your municipality. In addition, an advertisement is placed in a daily newspaper. You must pay these charges.
